Context
During 2005 the worldwide volume of business to business (B2B) commercial
transactions is expected to reach USD 8.5 trillion. Within this volume,
a large number of commercial disputes are inevitable. Since most commercial
entities prefer not to proceed before the courts of a foreign nation,
it is expected that a considerable number will seek to have their controversies
resolved by one form or another of Alternative Dispute Resolution (ADR).
The GMA Mission and History
The initial idea for GlobalMedArb (GMA) arose out of a series of lectures
on ADR delivered by one of its principals, Professor Robert Bennett Lubic,
in several small nations at the beginning of the present millennium. During
question and answer sessions, Professor Lubic was made aware of the considerable
expense involved in participating in international commercial disputes
conducted for the most part in the United States and Europe.
Especially disturbing to many of the enterprises that he addressed, forced
into the area of international trade by globalization, was being confronted
at arbitration or mediation hearings by a battery of high priced lawyers
retained by larger and wealthier opponents. In addition to exorbitant
legal expenses required to meet this challenge, were the costs and inconvenience
of international travel as well as the time involved to complete such
matters.
Although the Internet was starting to develop at that time, it was still
primitive in many of its aspects. Various forms of negotiation, mediation,
and arbitration functioning through Cyberspace, began being offered by
newly created providers under the generic term of Online Dispute Resolution
(ODR). Unfortunately, many of these offerings were dependent upon incomplete
forms of communications.
